Emerald Dolphin Rules & Regulations
Emerald Dolphin is both a primary residence and a vacation spot. The rights, comfort, safety, and security of all are important, as is the protection of each individual's investment in the property. Your adherence to the basic standards of conduct, common sense, and common courtesy is required. In this spirit, the Emerald Dolphin Homeowner's Association Board of Directors has enacted the following rules and regulations.
Note: Unit owners ultimately are responsible for their violations and for the violations of their children, guests, tenants, renters, contractors, and other users.
The following escalating fine structure is in effect:
- 1st Violation = warning;
- 2nd Violation = $50;
- 3rd Violation = $75;
- 4th Violation = $100;
- Subsequent violations = $100
Violations which result in damages to common areas or to individual units will subject the unit owner to payment for the entire cost of repairs and service, together with costs of collection and reasonable attorneys' fees and costs as necessary.
1. Safety- Nothing shall be done or kept in any unit, or in or upon the common elements, which will increase the rates of insurance of the building or the contents, result in the cancellation of insurance, or which will be in violation of any law. No material is allowed which is hazardous / combustible or would increase the risk of fire.
2. Laws and Regulations- No immoral, improper, offensive, or unlawful use shall be made of any unit, common areas or limited common areas, and all laws, zoning ordinances, and regulations of all governmental bodies having jurisdiction there over shall be observed.
3. Quiet Hours and Courtesy- Hours between 10pm and 8am are designated as quiet hours. Every effort should be made to avoid any nuisance that will disturb or annoy the occupants of any other units in the condominium.
- No disturbing noises, including pet noises, which would unreasonably interfere with the rights, comfort, or convenience of others, are allowed at any time. Televisions, stereo units, radios, musical instruments, and exercise equipment are not to be used or played at such volume or time that will annoy or disturb others.
4. Pool and Hot Tub- All persons entering the recreational areas do so at their own risk. The Emerald Dolphin Homeowner's Association will not be held liable for personal mishap, injury, or missing personal items.
- Pool/ Hot Tub hours are 8am to 10pm and will be strictly enforced. Additional rules are posted.
- Absolutely no pets, glass, personal umbrellas, or tents are allowed in the pool area.
- Children under the age of 14 must be accompanied by an adult. Infants must wear plastic pants over diapers in the pool and hot tub. Accidents or violations, which result in closing the pool for safety reasons and chemical treatment, will subject the owner or owner's guests, tenants or renters to payment for the entire cost of damages.
5. Common Areas- Skateboards, roller skates or blades, and scooters are not permitted on Emerald Dolphin property. Absolutely no riding of bikes or skateboards on parking ramp areas. There is a bike/ walking path in front of the property that will accommodate these recreational items.
- No smoking is allowed in the interior common areas, including the elevator. Cigarette butts must not be discarded on the lawn, in common areas, or off balconies.
- Fire codes prohibit any items on the walkways or in the stairwells. These areas must be kept clear and unobstructed. For example, storage receptacles, trash, trash bags or receptacles, coolers, beach chairs, bicycles and other vehicles with wheels, and toys are strictly prohibited.
- No modifications, alterations, repairs, decorations, or improvements to the exterior of any unit or any of the common elements are allowed without the express written approval of the Board.
- Jumping over or climbing on any of the property fences, including gates, is prohibited.
6. Individual and Common Area Balconies- Balconies or patios must be kept clean and clear of all items that adversely affect the exterior appearance and safety of the Condominium. For example, patio furniture, flower boxes and plants that sit on the floor are acceptable, but air conditioning units, refrigerators and any type of wiring, ducts or pipes are prohibited.
- No object (including towels, laundry, plants, and grills) may be attached to, draped, or hung from balcony railings. Flying the American Flag is allowed, as is flying military flags on designated holidays. Also permitted are flying military flags and the Blue Angels flag on the Blue Angels Beach celebration in July of each year; however, these flags must be displayed in a respectful way. These areas may not be used for storage. For example, bicycles may not be hung from or stored on balconies.
- Glass tops of any kind are not allowed on balconies. This includes plexi-glass, tempered glass etc. We suggest that only heavy weight furniture be placed on balconies so that they do not become flying projectiles and injure someone or something.
- No drilling into or fastening of any object to the concrete or exterior walls is allowed, except as specifically allowed in the Emerald Dolphin Hurricane Shelter Policy. In addition, any modifications to exterior surfaces, in order to access satellite TV services, must be reviewed by the Board prior to any modifications being made.
- Do not feed birds or throw any items, including cigarettes or cigarette butts, from the balconies.
- No signs, including FOR SALE/ RENT signs, are to be displayed on the units' balconies, doors, or windows.
- Electric or gas grills are allowed, but charcoal grills are expressly forbidden.
7. Pets- Pets must be leashed and under the immediate control of a responsible party while on Emerald Dolphin property.
- Use the pet elimination area (grass area north of the parking lot). All pet fecal matter must be bagged by the pet's owner immediately and disposed of properly. Pet clean-up bags and a receptacle are located near the dumpster at the northeast corner of the parking lot.
- Pets are not allowed in the fitness room, community room, hot tub, or pool area.
- Pets are not allowed on the Gulf or Sound side Beaches at any time. This is a Florida state law, and the fine imposed is $500.
8. Exercise Room- Use at your own risk. Children under the age of 14 must be accompanied by an adult. Additional rules are posted.
9. Parking- Parking spaces within the parking garage are privately owned by the unit owners. Parking in a unit owner's privately owned spot may result in the unit owner having your vehicle towed or booted (wheels locked), without warning, at your expense. There is open parking available on the north and west sides of the building on a 'first-com, first-served' basis.
- The open parking spaces are for vehicles only and should not be used as a storage area.
- Vehicle maintenance, such as oil changes, may not be performed in these open parking spaces.
- The Emerald Dolphin Homeowners' Association is not responsible for any losses of personal items left in any vehicle or the vehicle itself.
10. Parking Permits- Two parking permits will be issued annually to the owners of each unit by the Condominium Association Manager (CAM). Additional parking permits may be purchased for ten dollars each. Each parking permit will be assigned to a specific vehicle with records being maintained and updated by the CAM. This specific information must be provided, to the CAM, prior to you receiving your permits.
Parking permits for renters or guests will be issued by the Rental Agencies or Owners. Temporary parking permits can be acquired from the CAM during regular business hours. The temporary permits must specify, on the face of the permit, unit #, vehicle tag #, agency or owner issuing the permit and their contact phone #, and the duration of the permit, including expiration date.
Any unit owner who requests the CAM to issue a permanent permit for a long-term tenant must retrieve the permit from the tenant upon termination of the lease, and have the CAM cancel that permit in the records system.
Owners will be subject to fines for failure to follow the above rules for issuing temporary permits, by themselves or their rental agencies, and having permanent permits issued by the CAM.
Vehicles must display a valid parking permit (permanent or temporary) at all times (24/7) in the designated location within their vehicle with all information visible from the outside.
Failure to comply with the Parking Permit rules will result in fines, towing, or booting of the vehicle. In the event an Owner, Guest, or Tenant violate the parking rules and the vehicle is booted there will be an automatic $100 cash fine to have boot removed.
Any counterfeiting of parking permits will also result in fines and any vehicle that is parked in an open parking space, not in compliance with these rules, will be towed.
11. Association Luggage and Utility Carts- Carts are to be stored in designated areas on the 1st and 3rd parking levels only. No owner, tenant, renter, or guest shall store these carts in any other locations.
12. Trash- All trash must be placed in plastic bags and securely tied before placing it in the trash chute, or dumpster. You must break down boxes before placing them in the dumpster. No boxes, pizza boxes, or building materials can be put down the trash chute.
13. Elevators- The elevators must not be interfered with by any Unit Owner, Lessee, Renter, or other occupant of a Unit, or by their family, guests or visitors. Children under the age of (8) shall not be permitted to operate the elevators, or to be on the elevators unless accompanied by a parent or other adult. In addition, children, or adults, shall not play or loiter in the elevators.
Any moves, or large personal property, into or out of any Unit which must tie up an elevator for a period of time, must be scheduled in advance with the Condo Manager so that the move may be properly scheduled between 9:00 am and 5:00 pm.
BASIC ELEVATOR SAFETY RULES TO BE FOLLOWED
- Don't overload an elevator
- Don't try to leave a moving elevator
- Don't try to force elevator doors open
- Don't jump up and down to try to activate an emergency situation
- In case of emergency, use the call button for help
- In case of fire, do not use an elevator
- Watch your step getting on and off an elevator
- Don't interfere with opening and closing doors
***VIOLATIONS OF THESE GENERAL AND BASIC RULES WILL RESULT IN FINES AND REIMBURSEMENT COST TO REPAIR OR REPLACE.***
